The rights to exploit Hergé’s work belong exclusively, and worldwide, to the company Moulinsart, located at 162 avenue Louise, 1050 Brussels. Any reproduction, adaptation, translation, publication, distribution, performance, or public communication, in any form, on any medium, and by any means whatsoever, as well as any reproduction of derivative works, is prohibited without prior written authorization.
For original works
In accordance with applicable law—Article L122-8 and Articles R122-2 through 122-12 of the Intellectual Property Code— the buyer/bidder is liable to pay the resale right in favor of the artists and authors of the works sold at auction, in addition to the total sale price of the item when the hammer price exceeds 750; this resale right applies to living artists or those who have been deceased for less than 70 years. This obligation remains in effect even if the claim for these rights is made after the sale and removal of the lot, with no time limit. The auction house will not intervene in disputes regarding the validity of a claim for resale royalties. The total amount of royalties due for a single lot may not exceed 12,500 euros. We calculate the amount due as follows: Royalties for the portion of the hammer price (in euros) • 4% up to 50,000 • 3% between 50,000.01 and 200,000 • 1% between 200,000.01 and 350,000 • 0.50% between 350,000.01 and 500,000 • for amounts over 500,000 euros, the lower of 0.25% or 12,500 euros.
