CAMBACÉRÈS, Jacques-Jean-Régis de (1753-1824), archichanceli - Lot 140
CAMBACÉRÈS, Jacques-Jean-Régis de (1753-1824), archichancelier de l'Empire. L.S., to Citizen Hot Lawman in Macon. Paris, 8 pluviôse year 5 [January 27, 1797]. 1 p. ½ in-8, address on the back and postal mark "Conseil des Cinq-Cents". "I cannot blame, citizen, the circumspection of the Tribunal of Saône et Loire, although my opinion is made on the question which embarrassed it. If I were to judge the case by the presentation you make of it, it would seem that your opponents would not fulfil the wishes of the law of 12 Brumaire, even in the way they understand it. I do not know whether the Legislature would wish to give a partial decision on the subject at hand. The discussion will begin on the draft Civil Code, the title of paternity will be examined first: in this examination the legislature will embrace all the principles of the matter; and it will have the opportunity to fix the uncertainty of the judges without exposing itself to the incoherence of particular laws [...]". The law of 12 brumaire to which Cambacérès refers in this letter is that of 2 November 1793 (law of 12 Brumaire year 2) which had granted illegitimate children, when recognized by their parents, inheritance rights equal to those of legitimate children. This law had given rise to much controversy.
